Terms of Service
Last updated:
1 Our agreement with you
These Terms of Service are an agreement between GalaxySailLab Inc., doing business as Bota (Bota, we, us), and the person or organization accepting them (you). They cover our websites, recording devices and accessories (Hardware), device firmware, mobile and web applications, developer tools, APIs, SDKs, cloud infrastructure, transcription, summarization, and other services we provide (together, the Services).
You accept these Terms when you affirmatively agree to them during registration, checkout, activation, or another acceptance process. If you accept for an organization, you represent that you have authority to bind it. An individual using an organization’s account is an Authorized User; the organization is responsible for its subscription and the activities it authorizes. Merely being recorded by someone using Bota does not make a person a party to these Terms or waive that person’s rights.
An Order is an order form, checkout confirmation, or other purchasing document accepted by both parties that identifies the products, plan, fees, or additional commitments. A separately signed agreement governs the products it expressly covers. For other Orders, an applicable data processing agreement or business associate agreement controls its subject matter; expressly agreed special Order provisions control these Terms; and these Terms control general product documentation. An Order cannot reduce rights that applicable law makes nonwaivable.
Our Privacy Policy at https://bota.dev/privacy explains our handling of personal information. Acknowledging that notice is not consent to recording, optional tracking, or another activity requiring separate consent. A data processing agreement, if required, must be put in place before the relevant processing begins; no unprovided addendum is incorporated by this reference. No general license, Order provision, or incorporated policy authorizes model training contrary to Section 5.
2 Eligibility and geographic availability
You must be at least 18 years old and have reached the age of majority where you live to create an account, purchase, or independently use the Services. The Services are not offered as accounts for children. A person whose voice is lawfully included in a recording is not, for that reason alone, an account user. Section 4 governs recording other people, including minors.
We operate from the United States and make products available in the countries supported by the applicable offering. Availability of a website does not mean every product, shipping destination, wireless connection, language, or feature is supported there. You may not use or export the Services where prohibited by applicable sanctions, export controls, or other law. Mandatory local consumer and privacy rights remain applicable as described in these Terms.
3 Accounts and organizational access
Provide accurate account and purchasing information, safeguard your devices and credentials, and promptly notify support@bota.dev of suspected compromise. Do not share individual sign-in credentials. You are responsible for access you authorize and for reasonable security precautions within your control; you are not responsible under this clause for a security failure caused by Bota.
An organization may administer accounts and devices it provides, manage permissions and integrations, and access, export, retain, or delete content within its workspace or application as its plan and permissions allow. Its policies and notices govern those decisions. Use an appropriate personal account for content you do not wish to place under organizational control. A work email address alone does not authorize Bota to disclose unrelated personal-account content to an employer.
Organizations must ensure their Authorized Users understand applicable requirements and must promptly remove access when authorization ends. For a product supplied by a developer or reseller, that provider may manage your account and be your first point of contact for support, billing, and privacy requests.
4 Recording and the rights of other people
Before capturing, uploading, transcribing, analyzing, or sharing a conversation, you must have the rights and lawful basis needed for each activity. You must comply with applicable recording, interception, privacy, data protection, workplace, confidentiality, and professional rules, including rules applicable to the locations of other participants.
Give clear and timely notice of recording and relevant processing and obtain and maintain every consent or other authorization the law requires, including all-party consent where applicable. A person’s participation in a conversation, presence near a device, acceptance of another service’s terms, or failure to notice an indicator does not by itself establish valid consent. Device lights, sounds, prompts, and software notices assist with notice but do not determine whether your use is lawful.
Do not record where prohibited or use Bota for unlawful surveillance, stalking, covert monitoring, or interception. Pause or stop when authorization is absent, withdrawn, or no longer sufficient, and handle previously captured material according to applicable law. Obtain any additional permission required to record children or sensitive conversations. Do not represent a recording as legally admissible, authenticated, or complete solely because Bota created or processed it.
You control whom to record and the settings and commands you authorize, including remote or automated capture where offered. Secure those controls and avoid unintended capture. Business customers must provide appropriate notices to participants and their users and must not rely on these Terms as notice to people who have never seen them. Bota remains responsible for its own legal duties; this section does not transfer nondelegable obligations to you.
5 Customer Content and permitted processing
Customer Content means audio recordings, uploaded files, text, prompts, speaker labels, meeting information, and other material supplied through your account, together with resulting transcripts, summaries, notes, answers, and other generated material (Outputs). As between you and Bota, you keep the rights you have in Customer Content. To the extent Bota acquires transferable intellectual property rights in your Outputs, Bota assigns those rights to you. This does not create rights in another person’s information or promise that an Output is unique or copyrightable.
You authorize Bota, and providers acting on our behalf, to receive, host, reproduce, transmit, convert, transcribe, analyze, and otherwise process Customer Content only as needed to deliver the features you request, carry out your authorized settings and instructions, maintain and secure the Services, resolve support requests, and meet applicable legal obligations. Access for security or legal purposes must be necessary and proportionate. This permission continues only for the period needed for those purposes, including applicable retention and deletion obligations. It does not permit unrelated commercial exploitation of your conversations.
Bota does not use Customer Content to train, fine-tune, or develop AI or machine-learning models, and does not permit service providers processing Customer Content on Bota’s behalf to do so. This prohibition covers recordings, transcripts, summaries, prompts, Outputs, and content-derived training datasets, even if described as aggregated or de-identified. Performing the transcription, search, summarization, or other AI task you request is processing to deliver the Service and does not authorize model training. Feedback and service-improvement provisions do not override this restriction.
Our permission to handle Customer Content is subject to the Privacy Policy and any applicable data processing agreement. You are responsible for ensuring you may provide and direct the use of Customer Content; your authorization cannot waive another person’s independent rights.
6 AI features and review of results
AI features may produce errors, omissions, incorrect speaker assignments, fabricated statements, or incomplete interpretations. Recording quality, language, background noise, connectivity, and model limitations can affect results. Check Outputs against the source and use appropriate human review before relying on, publishing, or acting on them. Other users may receive similar Outputs.
The Services provide tools for recording and documentation. They do not provide medical, legal, financial, or other professional advice, establish a professional relationship, or replace qualified judgment. Do not use Outputs as the sole basis for decisions materially affecting someone’s health, employment, credit, insurance, legal rights, or safety. The Services are not emergency communication systems or safety-critical controls.
You decide whether an Output is suitable for your purpose and how to use it lawfully. These limitations do not exclude an express product promise or responsibility that cannot lawfully be excluded.
7 Sensitive information and regulated uses
Use appropriate access, consent, confidentiality, and security controls for sensitive information. Do not submit payment-card security codes, account passwords, or other unnecessary secrets in recordings or prompts. A speaker label or transcript is not verified identification of a person.
If your use requires Bota to act as a business associate under HIPAA, do not submit protected health information until Bota has agreed to that use, the required business associate agreement is effective, and you use only the covered products and configurations. A general reference to healthcare or security does not establish that every plan, AI provider, or integration is suitable for regulated data. Other specially regulated uses require the agreements and safeguards applicable to them.
8 Developer and infrastructure services
Subject to these Terms and your Order, you may use our APIs, SDKs, documentation, and developer services to build and operate your applications and deliver authorized features to your end users. Commercial applications and authorized white-label distribution are permitted within the purchased scope. A restriction elsewhere in these Terms must not be read to prohibit this expressly permitted developer use. Separate open-source licenses govern components released under those licenses.
You are responsible for your application, end-user terms and privacy notices, lawful recording flows, user authentication, account and tenant separation, access permissions, and actions your application initiates. Protect API keys, tokens, webhook secrets, and device credentials; use credentials with appropriate scope and revoke compromised credentials promptly. Do not place server secrets in publicly accessible applications or connect users to another customer’s recordings.
Observe the limits, metering rules, and technical requirements disclosed for your plan. Do not bypass security or usage limits, access other customers’ data, conduct unauthorized destructive testing, or interfere with service availability. Report suspected vulnerabilities to support@bota.dev. Responsible reporting does not authorize accessing or retaining another person’s data.
Compatibility, API versions, and supported firmware may change. We will give reasonable advance notice of material breaking changes when practicable, except where urgent security or legal action is needed. Support levels, capacity reservations, dedicated hosting, on-premises deployment, and availability guarantees apply only when expressly included in your Order. Sandbox and beta availability does not promise production capacity or a particular release date.
9 Integrations and authorized external actions
You may choose to connect independent products, including knowledge tools, AI assistants, storage services, or other applications. You authorize the transfers and actions described by the connection permissions and settings you approve, including recurring synchronization if enabled. Limit permissions to what you intend, verify destinations, and review an agent’s authority before allowing it to export information or take actions.
Independent services operate under their own agreements and privacy practices. Disconnecting stops future access through that connection but may not erase content already exported or copies a recipient retained. Bota’s no-training obligation applies to Bota and its processing providers; an independent service you direct us to send content to is governed by your relationship with that service. Bota remains responsible for transfers it makes outside your authorization or contrary to applicable law.
Providers Bota engages to operate the Services remain our service providers. We do not avoid our obligations by calling such a provider an optional integration.
10 Hardware use and software licenses
Follow the product’s safety, charging, storage, and operating instructions and use compatible accessories. Keep required software and firmware reasonably current. Check that recording is active when intended and that transfers have completed before deleting an original. Offline audio may remain only on a device until it successfully syncs; a device subscription does not include unlimited cloud storage, cellular service, or AI processing unless the Order says so.
We grant you a nonexclusive license to use Bota software and firmware with your authorized Services and Hardware. Bota devices remain Bota’s property. We provide them for your use while your subscription is active, and they must be returned when it ends, as described in Section 13. You may not sell, transfer, or lend a device to anyone outside your account.
Updates may be needed for security, compatibility, or continued cloud access. We will provide required notices and any consent choices required by law. Connected features stop working when your subscription ends. Statutory rights that cannot be waived remain unaffected.
11 Fees subscriptions and cancellation
Your Order must disclose the price, currency, taxes and shipping charges where required, billing interval, usage allowances, overage rates, and any minimum commitment. Subscription fees are charged per device for each billing period at the price shown in your Order. If your Order includes usage-based pricing, those fees accrue under the rules stated in it. We will not retroactively increase an agreed price for usage already incurred. You authorize charges you expressly approve to a payment method you are entitled to use.
An automatically renewing subscription renews for the interval disclosed at purchase until canceled. We will present the renewal terms and obtain the consent required by law before charging, provide a retainable confirmation, and send legally required renewal, trial-conversion, and price-change notices. A free trial converts to a paid plan only on the terms you affirmatively accepted. Uninstalling an app or ceasing to use a device does not by itself cancel a subscription.
For a subscription purchased directly from Bota, you can cancel online by emailing support@bota.dev or using the cancellation option in your account, once available. We will confirm your cancellation and send device return instructions. Cancellation will not require a phone call or an obstructive retention process. For an app-store purchase, manage cancellation through that store’s subscription controls. Cancellation stops renewal; access ordinarily continues through the paid period unless you request earlier termination or applicable law provides otherwise.
Unless your Order or mandatory law provides a refund, fees for a completed billing period and usage already delivered are nonrefundable. Statutory withdrawal rights, refunds for nonconforming products, refunds expressly provided in these Terms, and your right to dispute an unauthorized charge are preserved. Hardware returns do not automatically cancel a separately purchased subscription unless the bundle terms provide otherwise; we will explain any separate cancellation needed.
We will give at least 30 days’ advance notice of an increase to recurring fees, and any longer or additional notice required by law. An increase applies no earlier than renewal, or after the notice period for an ongoing usage plan. You may cancel before the increase takes effect. We will obtain renewed consent when required. If an undisputed payment is overdue, we may suspend the affected paid service after reasonable notice and an opportunity to resolve the failure.
12 Orders shipping and delivery
Hardware orders are subject to availability and acceptance. An automated receipt acknowledges your request; acceptance occurs when we expressly confirm acceptance or shipment. If we reject an order or cancel for unavailability, a material pricing error, suspected fraud, or a legal restriction, we will promptly refund charges for the unfulfilled portion. We will not charge a corrected higher price without your agreement.
Provide an accurate shipping address. We disclose supported destinations, shipping charges, estimated timing, and any customer responsibility for import charges before purchase. If shipment will be delayed, we will provide the notice, choice to consent to delay or cancel, and refund required by law. You may cancel an unshipped preorder for a full refund.
Unless a negotiated business Order provides otherwise, devices remain Bota’s property after delivery, as described in Section 10, subject to any stronger mandatory rule. Contact support@bota.dev promptly about missing, damaged, or incorrect items. Delay in reporting does not forfeit a nonwaivable remedy. Rentals, loans, managed fleet devices, replacement services, and white-label logistics require the applicable Order to identify ownership and return responsibilities.
13 Hardware returns and limited warranty
For Hardware purchased directly from Bota, you may return it at any time: notify support@bota.dev that you wish to return it and then send it within 14 days after receiving return instructions. Return the device and supplied components in good condition, allowing reasonable inspection and testing. We may deduct a reasonable, documented reduction in value caused by use beyond inspection or missing components, where lawful. Original packaging is helpful but is not a condition of a statutory remedy. A disclosed exception for customized goods affects only voluntary change-of-mind returns, not defect rights.
Unless a more favorable offer applies, you pay ordinary change-of-mind return shipping; Bota pays reasonable return shipping for an incorrect, damaged-on-arrival, or covered defective product. Returning a device cancels its subscription. The subscription ends on the day we receive the device, and we refund the unused part of the current billing period on a prorated basis. Refunds, together with any shipping amount required by law, go to the original payment method within 14 days after we receive the device, or sooner where applicable law requires. Where the law entitles you to a full refund, such as for an incorrect or damaged-on-arrival product, that right applies instead. We do not impose an undisclosed restocking fee. Reseller purchases follow that seller’s return process without reducing rights against Bota under a warranty or law.
Lifetime warranty with an active subscription. For as long as you keep an active Bota subscription for a device, Bota warrants to the original purchaser that new Hardware bought from Bota or an authorized seller will be free from defects in materials and workmanship under normal use. Coverage ends when the subscription ends; at that point the device must be returned to Bota as described below. Submit proof of purchase and a description of the problem to support@bota.dev. Bota will, at its expense and subject to mandatory rights, repair the product, replace it with a new or equivalent refurbished product, or refund its purchase price. A replacement or repair is covered for the rest of the warranty period.
This additional warranty excludes normal wear, cosmetic damage not caused by a defect, and damage caused by misuse, accidents, unsuitable accessories, or unauthorized modification or repair. An exclusion applies only to the extent the excluded conduct caused the problem; lawful third-party repair does not automatically void coverage. Consumable battery capacity naturally declines, but a defective battery is not excluded merely because it is a battery. Bota pays reasonable shipping costs for a valid warranty claim.
Returning devices when a subscription ends. When the subscription for a device ends, for any reason, you must return the device and its supplied components to Bota. We will email return instructions, and you should send the device within 14 days after receiving them.
Back up, unpair, and erase a device before transfer, return, or repair if you can safely do so. If a defect prevents erasure, tell us before sending it so we can arrange appropriate handling. We will protect personal information on returned devices and limit access to what is needed for support, repair, secure erasure, or legal obligations. No clause here disclaims our own data-protection responsibilities.
This warranty and voluntary return policy add to your mandatory rights. Some jurisdictions provide longer guarantees or additional remedies. Any more favorable warranty or replacement commitment made for your Order continues to apply; these Terms do not withdraw an existing purchased benefit.
14 Consumer rights outside the United States
Consumers retain the protections of mandatory local law, including rights concerning delivery, conformity, digital services, updates, cancellation, and remedies. California law and the liability provisions below do not remove those protections.
Where EEA or UK distance-contract withdrawal rights apply, the usual withdrawal period is 14 days from receipt of goods or conclusion of a service contract, subject to legal exceptions. You may give an unequivocal withdrawal notice to support@bota.dev. We provide any required precontract information and withdrawal form with the offer. Starting a service during that period, charging for the portion supplied, or ending a withdrawal right for digital content requires the separate requests, acknowledgments, and conditions required by law; accepting these Terms alone is insufficient.
For Australian consumers, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Remedies for major failures and other failures apply as required by that law. Nothing in these Terms excludes equivalent nonwaivable protections in other countries. Country-specific notices supplied with an offering control to the extent required locally.
15 Acceptable use and intellectual property
Do not use the Services to violate another person’s privacy or intellectual property rights; exploit children; commit fraud; distribute malicious code; unlawfully impersonate someone; or obtain unauthorized access to systems or content. Do not defeat recording notices, access controls, usage limits, or other safeguards to facilitate unlawful use. Do not use the Services for unlawful biometric identification or discrimination.
Bota and its licensors own the Services and related technology, designs, documentation, and marks, excluding Customer Content and third-party rights. You may not copy, redistribute, or reverse engineer proprietary components beyond the permission granted here, a separate license, or applicable law. Nothing restricts rights that cannot legally be restricted, including applicable interoperability, repair, and open-source rights. The authorized API and SDK use in Section 8 remains permitted.
You may provide voluntary product suggestions. We may use those suggestions without compensation, but this does not give us broader rights in recordings, personal information, confidential material, or Customer Content included with a support request. Report suspected infringement or unlawful recording to support@bota.dev with enough information to identify the issue; do not unnecessarily send sensitive recordings.
16 Business data handling and confidentiality
When Bota processes personal information in Customer Content for a business customer, we act on its documented instructions as specified in the applicable contract and data processing agreement, except where law requires otherwise. We will maintain reasonable administrative, technical, and organizational safeguards, restrict personnel access, and use processing providers subject to confidentiality and appropriate data-protection obligations. We will notify the customer without undue delay after becoming aware of a personal-data breach affecting that content and provide information and cooperation required by the applicable agreement and law.
Each party will protect nonpublic information received from the other that is identified as confidential or reasonably should be understood as confidential, use it only for the agreement, and share it only with recipients who need it and owe suitable confidentiality duties. Customer Content is included. These obligations exclude information lawfully known without restriction, independently developed, received lawfully from another source, or made public without breach. A legally compelled disclosure must be limited to what is required, with advance notice where lawful and practicable.
These confidentiality duties last while the information remains confidential, and trade secrets remain protected for as long as applicable law protects them. Privacy rights and contractual data-handling obligations survive for retained personal information. Processing schedules, international-transfer provisions, audit procedures, and service-specific obligations must be addressed in a separate data processing agreement when required.
17 Changes beta features and service availability
We may maintain and improve the Services and offer experimental features identified as beta or preview. Such features may change or be withdrawn, have additional limitations, and should be evaluated before production use. Confidentiality, privacy, and the no-training commitment still apply. Do not place regulated data into a beta feature unless expressly authorized for that use.
We will give reasonable advance notice of discontinuing a paid Service or materially reducing its core functionality when practicable. If we discontinue it or materially reduce the functionality you purchased during a prepaid term, you may terminate the affected portion and receive a proportionate refund for the unused period. Urgent security and legal changes may take effect sooner. Mandatory remedies for Hardware dependent on discontinued digital services remain available.
18 Suspension termination and access to data
You may stop using the Services, cancel renewal, or request account deletion. Cancellation, deletion, and withdrawal from a purchase have different effects as described above and in the Privacy Policy. Obligations to pay for authorized usage already delivered or a valid business commitment remain due, subject to applicable refund and consumer rights.
We may suspend affected access where reasonably needed to address material misuse, an immediate security threat, overdue undisputed charges, or a legal requirement. We will limit the scope and duration where practicable, explain the reason unless prohibited or unsafe, and restore access when the issue is resolved. Either party may terminate for a material breach not cured within 30 days after notice, or immediately if it cannot be cured. We may close a free account on reasonable notice, subject to mandatory law.
After ordinary expiration or termination of a paid account, we will provide a 30-day opportunity to export Customer Content using available export tools or a reasonable support process. This does not postpone a deletion you request, a shorter retention setting you chose, or a deletion required by law. We may restrict retrieval where necessary to address illegality or a specific security risk, but will offer a lawful alternative where reasonably possible. We do not promise indefinite storage. Deletion and residual retention follow the Privacy Policy and any applicable data processing agreement.
On termination, licenses and access end except as needed for an authorized export period. Provisions concerning accrued payments, ownership, confidentiality, retained data, indemnification, liability, and dispute resolution survive as their purpose requires. Devices must be returned as described in Section 13.
19 Warranties and service limitations
We will provide the paid Services with reasonable care and skill. Express warranties in Section 13, your Order, and mandatory law remain in effect. Subject to those commitments and to the maximum extent permitted by law, the Services are otherwise provided as available, and Bota disclaims implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
We do not promise uninterrupted availability, error-free AI results, universal wireless coverage, or that every recording or upload will succeed. You should keep appropriate copies of important material. These limitations do not excuse Bota from its express security, privacy, confidentiality, refund, or other obligations or from liability that cannot be excluded.
20 Limitations of liability
TO THE EXTENT APPLICABLE LAW ALLOWS, NEITHER PARTY IS LIABLE TO THE OTHER FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THESE TERMS, INCLUDING LOST PROFITS OR BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THEIR POSSIBILITY.
TO THE SAME EXTENT, EACH PARTY’S TOTAL LIABILITY ARISING FROM THESE TERMS IS LIMITED TO THE GREATER OF: (A) THE FEES PAID OR PAYABLE TO BOTA UNDER THE AFFECTED ORDER DURING THE 12 MONTHS BEFORE THE FIRST EVENT GIVING RISE TO THE CLAIM; (B) THE PRICE PAID FOR THE HARDWARE THAT GAVE RISE TO THE CLAIM; OR (C) US$100. RELATED CLAIMS SHARE ONE LIMIT. THESE LIMITS DO NOT REDUCE PAYMENT OBLIGATIONS FOR SERVICES PROPERLY DELIVERED OR REFUNDS AND WARRANTY REMEDIES EXPRESSLY OWED UNDER THESE TERMS.
The exclusions and limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that applicable law prohibits limiting. They do not waive privacy rights, statutory damages, or consumer remedies to the extent a waiver is prohibited. For a consumer, liability for reasonably foreseeable loss caused by our breach remains recoverable where mandatory law so requires.
21 Business customer indemnification
This section applies only when you use the Services for a business or professional purpose, not as a consumer. You will defend Bota against third-party claims arising from your unlawful recording, your Customer Content infringing another person’s rights, or your application’s material violation of these Terms, and pay damages and reasonable costs finally awarded or agreed in a settlement you approve. You owe no indemnity to the extent a claim results from Bota’s breach, negligence, or misconduct.
Bota will promptly notify you of a covered claim, allow you to control the defense with competent counsel, and reasonably cooperate at your expense. Late notice reduces your obligation only to the extent it materially prejudices the defense. You may not settle by admitting wrongdoing by Bota, imposing a nonmonetary obligation on Bota, or failing to release Bota without its written consent, not unreasonably withheld. The limits in Section 20 apply unless a separately negotiated agreement expressly says otherwise.
22 Governing law and disputes
California law governs these Terms, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods. Subject to mandatory consumer rights, disputes must be brought in the state courts in Santa Clara County, California, or the federal courts in the Northern District of California, and each party consents to those courts.
If you are a consumer, this choice does not deprive you of mandatory protections where you habitually reside or require you to bring a claim outside a forum that mandatory law makes available to you. These Terms do not impose mandatory arbitration or waive class, representative, or public-injunctive relief. Either party may contact the other first to seek a practical resolution, without delaying a filing deadline or a right to urgent relief.
23 Updates to these Terms
We may revise these Terms prospectively. For a material change, we will give at least 30 days’ notice through your account or contact email, unless an urgent legal or security need requires a shorter period. We will explain the effective date and any action required. Changes to accrued disputes are not retroactive. Where law requires affirmative acceptance, continued use alone is not sufficient.
If a material change adversely affects an existing prepaid subscription and you do not agree, you may terminate the affected portion before the change takes effect and receive a proportionate refund for the unused period. Changes to privacy practices must also satisfy the Privacy Policy and applicable law; posting new Terms does not itself authorize a new use of previously collected recordings.
24 Other provisions and contact
These Terms and the applicable agreements identified in Section 1 form the agreement for the covered Services. An invalid provision will be severed to the extent possible without defeating the agreement’s lawful purpose. Failure to enforce a provision is not a waiver. Neither party is responsible for delay caused by events beyond its reasonable control if it takes reasonable steps to mitigate the effects; this does not excuse amounts already owed, mandatory refunds, or statutory duties.
You may not assign the agreement without our consent, except as permitted by law. Bota may assign it in a merger, reorganization, or sale of the relevant business if the successor assumes the obligations and the assignment does not diminish your mandatory rights. No assignment expands permitted uses of personal information. Neither party may use the other’s name or logo as a customer endorsement without permission.
We send contractual and service notices through the account or email you provide; marketing preferences are separate. If a translation is supplied, English controls only to the extent local law permits. The agreement does not make a recorded participant a contracting party or limit a regulator’s authority.
